| Hosking Tours Limited accept reservations on the
following conditions: |
- Hosking Tours Ltd. is not licensed to sell Airline tickets,
but can arrange for flights to be booked for clients if they so
wish. Under these circumstances flights will be booked through
an accredited ATOL License Holder, who will normally require payment
in full for the ticket at the time of booking. All such flight
bookings will be subject to the License Holders Booking Conditions,
a copy of which can be provided. When such a flight booking is
made a contract will exist between you, the client, and the License
Holder, once the confirmation of booking is issued. Clients making
their own flight arrangements should note that Hosking Tours cannot
accept any responsibility for the late arrival of such flights.
Clients should note that any such delay could result in the said
clients missing the tour departure. Unless otherwise specified
all other arrangements are the responsibility of Hosking Tours
Ltd. and are subject to the Booking Conditions set out below.
- Registration is accepted only after the company has received
the deposit and completed booking form and issued the client with
an acknowledgement and final account. The outstanding balance
must be paid by the due date otherwise the company has the right
to regard the booking as cancelled. No variation of these conditions
shall form part of any contract between the company and the client
unless it is contained in writing by the company to the person
signing the booking form. The contract is made subject to English
law and jurisdiction, and questions as to liability, quantum and
all proceedings shall be within the exclusive domain of the English
courts.
- Cancellation: After the booking has been acknowledged cancellation
will be accepted up to 90 days before the departure date. Up to
this date all monies, except the 10 per cent deposit and the full
cost of the air ticket, will be refunded. After 90 days before
departure a 90 per cent refund will only be made if a substitute
can be found. Clients who take out insurance cover through the
company are covered in the event of their cancellation due to
illness, redundancy, jury service or death, illness or injury
of a close relative or business associate. Clients not taking
out insurance through the company are strongly recommended to
ensure that their own insurance covers them for these eventualities.
- The company acts only as agent for the owners, suppliers of
transport and local agents/operators, and or other related travel
services provided and assume no liability or responsibility for
additional expenses howsoever caused arising directly or indirectly
from the actions or omissions of such independent parties accidents,
loss or damage to persons or property, delays, transport failures,
strikes, wars, force majeure, acts of God etc., over which the
company has no control, including acts of terrorism. Clients not
arranging insurance through the company are strongly advised to
insure adequately for the duration of their tour in respect of
illness, injury, death, baggage and personal effects.
- In respect of some tours, semi-wild animals may be encountered
in and around the accommodation provided and at locations for
photography, etc. The owners/proprietors of such accommodation
and locations will usually require a Disclaimer of Liability form
to be signed. The latter will generally only be available at the
accommodation or location site. The Company will also require
a Disclaimer of Liability in such a case. All best endeavours
will be used by the Company to furnish the latter prior to departure.
- While the company will use its best endeavours to operate all
tours as advertised. the company reserves the right to make changes
to itineraries, in the interests of safety and for the general
well-being of clients, in the case of any material changes, or
of cancellation, the company will offer alternative arrangements
or a full refund of all monies paid. No refund will be made for
any unused services which are included in the tour price. The
company reserves the right to cancel a tour up to twelve weeks
prior to departure if the minimum group size is not reached. In
the unlikely event of this happening all monies paid will be refunded.
- Prices quoted for tours are based on exchange rates and agents'
fees at the time of publication, however, as external factors
may affect the exchange rates, transportation and accommodation
charges, the company reserves the right to alter the price of
any tour and forward an amended invoice if any such variation
results in an increase of more than 10 per cent of the total tour
cost (excluding airfare). In such circumstances the client may
cancel the booking and obtain a complete refund not less than
twelve weeks before the departure date, other than insurance premium
costs. In such a situation clients must notify us in writing within
seven days of receipt of the amended invoice to qualify for reimbursement.
- Tour Leaders: Whilst every effort is made to keep the leader
secured for a tour, we reserve the right to substitute another
leader if due to ill health or for any other reason the advertised
leader is unavailable.
- Clients are required to have insurance cover. This does not
have to be through the company, but the company does offer a standard
policy the basic details of which are as follows: Medical and
other related expenses - £10,000,000. Cancellation and curtailment
charges - Up to the cost of the tour. Personal Accident and loss
of life, sight or limbs - £25,000. Personal luggage - £1,500*
(limited to £250 any one item, with an excess of £25 per item).Claims
under most sections of the policy will carry an excess of £50
* For some items the above cover may not be sufficient, in which
case please discuss with the company if you require additional
cover under the policy. It is a condition of booking that all
clients obtain full insurance cover. A detailed policy is available
on request.
- The quoted cost of tours does not include any airport taxes,
if levied, drinks other than those included with fixed meals or
any items of personal spending.
- Medical vaccinations and other preliminary arrangements including
all visa procurement are entirely the clients' responsibility
and the company accepts no responsibility in the event of these
not being completed in time for departure. The company will normally
assist with the obtaining of visas.
- The Booking Form contains a declaration which it is necessary
for all clients to sign which states categorically that no client
is travelling (a) contrary to medical advice, (b) in contemplation
of obtaining medical treatment, (c) after a terminal prognosis
has been made or, (d) when they are suffering from any pre-existing
condition, illness, disability, ailment or similar which it is
reasonable to assume would be worsened by partaking in the tour.
- All Clients must appreciate and understand that the itinerary
of tours often includes somewhat onerous travel arrangements e.g.
poor and/or inadequate road surfaces, weather conditions etc.
and these should be borne in mind when signing the declaration
referred to in Condition 12 above.
- The company reserves the right to decline any booking.
- All cheques should be made payable to Stephen Webb & Co.
Solicitors/Hosking Tours Limited and sent to Hosking Tour Limited,
Pages Green House, Wetheringsett, Stowmarket, Suffolk, IPl4 5QA.
This is an Escrow Account held jointly with the company's Solicitors.
All deposits and final balances are held in this account pending
the departure of the tour. It is held in this manner to provide
full protection to clients in the event that the company were
to become insolvent. The account is administered by Stephen Webb
& Co. Solicitors, 9A Cross Street, Eye, Suffolk, IP23 7AB.
